WHAT COULD BE THE POSSIBLE REASONS FOR NOT ENFORCING LONG OVERDUE CONDITIONS?

The recommendation by Antonia James (Case Officer), Ruth Cambers (Area Team Leader) and David Prentis (Head of Planning Services) gives the following Reasons to grant planning consent:
  • The works would protect the special character, the historic fabric and the appearance of the Listed Building.
  • The development would preserve the special character and appearance of the Conservation Area.
  • Any potentially significant impacts on the amenities of nearby dwellings can be satisfactorily migated by conditions.
Conditions:
  1. Notwithstanding any materials shown as part of the submitted application, details and samples of any materials to be used externally, and any means of enclosure to be used, including details and samples of the gates, railings, finials and the planter must be submitted to and approved by, the Local Planning Authority within one month of the date of this decision, and the works shall be carried out in accordance with the details within one month of approval of those details.
  2. The two internal units shown on the submitted plan are to be fixed to an exposed timber frame are to be set away from the timber frame by using spacer brackets. This work is to be carried out within one month from the date of consent.
  3. The four external units shown on the submitted plan are to be secured to the building and the wall using stainless steel fixings. The work is to be carried out within one month from the date of consent.
The Planning permission was granted 10 August 2005.

21 October 2005 — Gleeds submit details of proposed gates, railings and finials; a planter will be identified once the fencing has been erected. (planning application TW/05/3003/sub/ARJ)

30 November 2005 — John Kaye, TWBC Conservation Architect, reports to Tony Fullwood, TWBC Head of Strategy and Development.

10 April 2006 — 1 year after carrying out the works — Conditions to the planning consent have still not been met.

End 2006 — No enforcement.
